13,021 DNC complaints — 730 per 100,000. That rate beats New York. Callers do not skip 304.

Federal floor: TCPA $500 / $1,500.

West Virginia layer:

  • State consumer-protection / telemarketing rules and AG enforcement.
  • No Florida-style private $500 mini-TCPA. The per-call private engine is the TCPA.
  • West Virginia signed the 49-AG FCC letters.

What changed: No 2026 mini-TCPA. The per-capita complaint rate is the variable.

Left on the table: 13,021 × $500 ≈ $6.5 million. × $1,500 ≈ $19.5 million.
