Texas Quarterly Law Update: SB 140 Is Live — Texts and Images Count, DTPA Stacks, and 6.11 Billion Robocalls Landed in 2025

State-by-State Updates

YouMail: 6,107,772,500 robocalls in 2025, 3,466,492,900 already in 2026. Dallas and Houston are permanent U.S. top-five metros. San Antonio stays on the board. 228,370 DNC complaints — 770 per 100,000. November 2025 alone: about 399 million calls, #1 in the country.

Federal floor: TCPA $500 / $1,500.

Texas layer — SB 140, effective September 1, 2025:

  • “Telephone solicitation” now includes a call, text, graphic message, or image sent to induce a purchase, rental, claim, or receipt of an item.
  • A Mini-TCPA violation is a false, misleading, or deceptive act under the DTPA (Bus. & Com. Code ch. 17). Private DTPA remedies apply — actual / statutory path commonly described as $500, with treble exposure for knowing or intentional conduct, plus fees. The AG may seek civil penalties cited at up to $5,000 per violation. Chapter 302 registration violations are separately cited at $5,000.
  • The old “complain to the AG first and wait” hurdle is gone.
  • Prior recoveries do not cap a later case on a later call.
  • Registration and bond rules remain for sellers calling from or into Texas.
  • Hours and two-registry scrubbing (federal + Texas No-Call) still matter.

What that means: Same illegal text can be a federal TCPA count and a Texas DTPA / Mini-TCPA count. That is why Texas jumped from “hot” to “must-comply” on every national calling desk.

Left on the table: 228,370 × $500 ≈ $114.2 million federal floor. × $1,500 ≈ $342.6 million. Stack state DTPA math and the same complaint pile becomes an industry.
