Oregon layer — HB 3865 (2025 Or. Laws ch. 580), effective January 1, 2026:
- Amends ORS 646.561 so a text message is a telephone solicitation.
- Unlawful practice under the Unlawful Trade Practices Act (ORS 646.608) to solicit before 8 a.m. or after 8 p.m., to make more than three solicitations in 24 hours, or to falsify identity or purpose.
- Caller-ID spoofing rules; substantial-assistance liability for facilitators.
- UTPA private actions (ORS 646.638) remain the state damages path — typically actual damages or a statutory floor, plus fees in a proper case. Pair that with TCPA for the per-call federal count.
What changed: HB 3865 is the 2026 event. If your Oregon log still treats texts as a gray area, update it.
