New York’s Attorney General logged nearly 30,000 consumer complaints in 2025. Retail scams, internet fraud, and auto-dealer disputes led the list. GBL 349 and GBL 350New York General Business Law §§ 349 and 350 — ban deceptive business practices and false advertising. A private plaintiff does not have to prove the company meant to lie. The test is consumer-oriented conduct that is materially misleading to a reasonable consumer and that caused actual injury. Remedies can include actual damages or the statutory floor, discretionary treble damages in New York, and attorney’s fees. The statute of limitations on GBL 349 is three years.
