Missouri Quarterly Law Update: $5,000 Per Knowing No-Call Hit, 1.16 Billion Robocalls, and the MMPA on the Sale That Follows the Ring

State-by-State Updates

YouMail: 1,158,075,500 robocalls in 2025, 689,951,700 in 2026 YTD. The Missouri AG has separately cited 513.8 million robocalls into the state in early 2026 — about 88.5 calls per person affected. 42,440 FTC DNC complaints — 688 per 100,000, up 32.8%. The AG’s own No-Call Unit logged more than 33,600 state no-call complaints in 2025 and called it the office’s top consumer complaint.

Federal floor: TCPA $500 / $1,500.

Missouri layer — this is the one to memorize:

  • Missouri No-Call Law, RSMo §§ 407.1095–407.1110. AG civil penalty up to $5,000 per knowing violation.
  • Private right, § 407.1107.3: if you received more than one telephone solicitation in any 12-month period by or on behalf of the same person or entity in violation of the no-call rules, you may enjoin the conduct and recover the greater of actual loss or up to $5,000 per knowing violation. Two-year state limitations period. Written procedures can be a defense.
  • Telemarketing Law, §§ 407.1070–407.1085. No calls 9 p.m. to 8 a.m. Separate penalties up to $1,000 for certain telemarketing-conduct violations even off the list.
  • MMPA, § 407.010 et seq. The sale that follows the ring — deception, concealment, unfair practice. Actual damages, possible punitive damages and fees. That is Series Two: MMPA Justice.

What changed: No 2026 rewrite of the $5,000 private count. AG Hanaway joined the 2026 FCC carrier letters. The practice point is still the second call in 12 months — that is what opens § 407.1107.

Left on the table: 42,440 × $500 ≈ $21.2 million federal floor. × $1,500 ≈ $63.7 million. If a slice of those files also qualifies for $5,000 under the No-Call Law, the same complaint pile becomes a different industry. Almost none of it is being collected.
