Imperial, Missouri – June 28, 2026 — Christopher Prosser, founder of TeleJustice Academy and a longtime advocate for consumer protection against illegal telemarketing, has won a significant appellate victory in the Missouri Court of Appeals, Eastern District. On June 16, 2026, the court reversed the circuit court’s dismissal of Prosser’s three-count petition alleging violations of Missouri’s Do Not Call and No Call statutes stemming from three unsolicited text messages sent to his residential phone number registered on the Missouri Do Not Call List.

The Eastern District held that the motion to dismiss filed by defendant Daniel Kellas on behalf of Over There Land Company, LLC was a legal nullity. Because Kellas is not a licensed Missouri attorney, he was unauthorized to practice law by filing pleadings on behalf of the LLC, a separate legal entity that can only appear in court through licensed counsel. The court vacated the judgment dismissing Prosser’s claims with prejudice and remanded the case for further proceedings consistent with its opinion.

“This victory is not just about one case — it’s about protecting everyday Missouri consumers from illegal robocalls and texts that violate our state’s strong consumer protection laws,” said Christopher Prosser. “I will continue fighting for the rights of consumers who are harassed by telemarketers. The Missouri Bar featured the decision in its recent Case Summaries for June 12-25, 2026, highlighting the key holding that only licensed attorneys may represent legal entities such as LLCs, and that a non-attorney’s attempt to do so invalidates the pleading.
