- M.G.L. c. 93A — unfair or deceptive acts. Private action after a 30-day written demand. If the defendant refuses a reasonable tender, a court may award up to treble damages plus attorney’s fees.
- 940 CMR 30.00 telemarketing regulations: disclosures, hours, and DNC scrubbing for Massachusetts numbers.
- No Florida-style standalone $500 mini-TCPA. Stack TCPA per call with a 93A count when the pitch itself was unfair or deceptive.
What changed: No 2026 mini-TCPA. Massachusetts signed the 49-AG FCC carrier letters. The live practice point is still the 93A demand letter — miss the 30 days and you weaken the fee-shifting hammer.
Left on the table: 48,190 × $500 ≈ $24.1 million. × $1,500 ≈ $72.3 million.
