Federal floor: TCPA $500 / $1,500.
Maine layer — the 2024 change:
- Maine amended its Telephone Solicitation Act (10 M.R.S.A. § 1499-B) so a seller may not place a telephone sales call without checking the National Reassigned Number Database and the DNC lists. Effective after the March 25, 2024 signing.
- No private right of action on the state Act. The AG enforces. Civil penalties: not more than $10,000 first violation, up to $25,000 each later one.
- Safe harbor tracks the federal DNC safe harbor plus the reassigned-number scrub.
What that means for you: The state law is a reporting and AG tool. The check you can cash per illegal autodialed or DNC voice call is still the federal TCPA. When a caller hits a number that used to belong to someone else, the new scrub rule is the fact you put in the complaint.
Left on the table: 7,234 × $500 ≈ $3.6 million. × $1,500 ≈ $10.9 million.
