Indiana Quarterly Law Update: 1.1 Billion Robocalls, AG Fines to $25,000, and Why Indianapolis Still Has a Federal Claim After Steidinger

State-by-State Updates

YouMail: 1,117,330,800 robocalls in 2025, 674,889,200 in 2026 YTD. Indianapolis stays on the national city list. 48,652 DNC complaints — 714 per 100,000, up 47.8%, one of the sharpest jumps in the Midwest.

Federal floor: TCPA $500 / $1,500 on illegal voice robocalls and autodialed prerecorded sales calls.

2026 change: Steidinger (7th Cir., July 14, 2026) says marketing texts are not “telephone calls” under TCPA § 227(c)(5). Binding in Indiana. Build voice-call and § 227(b) files. Do not assume a STOP-text chain is a DNC private action in this circuit.

Indiana layer:

  • Telephone Privacy Act / autodialer rules, IC 24-5-14 and the state Do Not Call chapter (IC 24-4.7). Live-operator permission before a recorded pitch. Vicarious liability theories appear in the code.
  • A state violation is a deceptive act. AG civil penalties: up to $10,000 first violation, up to $25,000 each later one (IC 24-5-14-13). Deceptive-act penalties of $500 / $1,500 knowing also appear in IC 24-5-0.5-4.
  • Indiana led the Anti-Robocall Litigation Task Force. The AG’s telephone-privacy team processed thousands of complaints in FY2025 and is co-leading the 50-AG Avid Telecom case.

Left on the table: 48,652 × $500 ≈ $24.3 million. × $1,500 ≈ $73.0 million. That is the private federal floor on complained-of calls. The AG’s $10,000/$25,000 stick is public enforcement — report those patterns.
