YouMail: 3,340,066,000 robocalls in 2025, 2,068,630,200 in 2026 YTD. Atlanta has repeatedly been #1 in the U.S. on monthly city lists (133.8 million in September 2025 alone). Augusta appears in the top 15. 89,691 DNC complaints — 829 per 100,000, up 34.1%.
Federal floor: TCPA $500 / $1,500.
Georgia layer — SB 73, effective July 1, 2024 (amending O.C.G.A. telemarketing / Fair Business Practices provisions):
- Private right of action against the caller and the company the call was made for (vicarious liability).
- Ignorance is not a defense. Written policies can still be a safe harbor if they were real and enforced.
- Individual damages commonly described as the greater of actual loss or up to $1,000 per knowing violation, plus fees.
- Class actions expressly allowed; the per-violation cap is widely treated as not capping class-wide statutory math the way it used to.
- Calling hours typically 8 a.m.–9 p.m.
What changed: SB 73 is the change. 2025–26 has been the first full stretch of plaintiff firms using it. Georgia also had mini-TCPA bills still moving in the 2026 session — watch the legislature, but do not wait on them to log today’s calls.
Left on the table: 89,691 × $500 ≈ $44.8 million federal. × $1,500 ≈ $134.5 million. Add a $1,000 state count on the same calls and the file grows again. Atlanta’s monthly totals make a single campaign look like a class on paper.
Save the caller ID, the vendor name they blurt in the first three seconds, and the company they are selling. That third-party vendor is now in the statute on purpose. Use the Georgia Playbook.
