Federal floor: TCPA $500 / $1,500.
Florida layer — the original mini-TCPA: Fla. Stat. § 501.059 (FTSA).
- Prior express written consent for automated sales calls and texts.
- Hours: 8 a.m.–8 p.m.
- Three sales calls on the same subject per 24 hours.
- Private action: greater of actual damages or $500, trebled to $1,500 if willful or knowing, plus fees.
- Stacks with TCPA. Same call can be $1,000–$3,000.
- 2023 text amendment: before you sue over texts, reply STOP and wait 15 days. If they keep texting, the claim proceeds.
AG / FDACS can also levy administrative fines. Willful state enforcement figures are sometimes cited as high as $10,000 on the public side.
What changed: The 15-day STOP rule is the one that still surprises people. Miss it and the text count gets knocked out. Voice-call FTSA claims do not use that trap.
Left on the table: 204,702 × $500 ≈ $102 million federal floor. × $1,500 ≈ $307 million. Stack FTSA and the same complaint file roughly doubles. Four billion estimated robocalls is why Florida plaintiff firms never left.
