Alabama is not a quiet phone state. YouMail’s Robocall Index put 1,497,196,800 robocalls into Alabama in 2025. Through early 2026 the meter was already past 959 million. Birmingham still ranks among the country’s most-hit metros.
2025 Do Not Call complaints: 39,335 — 778 per 100,000 residents, up 58.8% from 2024. That was the second-largest jump in the country.
Federal floor (every state): TCPA, 47 U.S.C. § 227 — $500 per illegal call or text, $1,500 if a court finds the violation knowing or willful. Four-year limitations period. No aggregate cap.
Alabama layer:
- Telephone Solicitations Act, Ala. Code § 8-19C. State Do Not Call register at the Public Service Commission. Solicitors must identify themselves and must not block caller ID. A consumer who gets more than one illegal solicitation from the same seller in 12 months may sue for an injunction and the greater of actual loss or up to $2,000 per knowing violation. Two-year state limitations period.
- Deceptive Trade Practices Act, § 8-19-10. Greater of actual damages or $100, possible treble damages, attorney’s fees. 15-day written demand before filing.
What changed: No 2026 rewrite of 8-19C. Federal one-to-one consent rules still matter for lead-gen calls into Alabama.
Left on the table: If only the 39,335 complained-of calls had been litigated at the federal $500 floor, that is about $19.7 million. At $1,500, about $59 million. Stack a qualifying 8-19C $2,000 count and the same file gets larger. Almost none of that is being collected because most Alabamians hang up instead of logging the call.
